1. Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of the website www.posit-ev.com and the Posit+EV subscription service (together, the "Service"), operated by PositEV ("we," "us," or "our").

By creating an account, subscribing to our newsletter, or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

2. Description of Service

Posit+EV provides sports betting data and analytics — including odds comparisons across sportsbooks, prediction markets, and betting exchanges, expected-value (+EV) calculations, model-derived probabilities, and related statistical signals.

Posit+EV is not betting advice, and we are not a licensed sportsbook, bookmaker, or gambling operator. We do not accept wagers, hold funds, or place bets on your behalf. All betting decisions and any wagers you place are made entirely at your own discretion, with third-party sportsbooks, exchanges, or prediction markets that are not affiliated with us. You are solely responsible for confirming that sports betting is legal in your jurisdiction before using any information from this Service to place a wager.

3. Subscription Terms

The Service offers a free tier (one daily pick delivered by email, no account or payment required) and a paid tier, EV Pro, billed at $10/month after a 7-day free trial.

• Trial period. When you start an EV Pro trial, a valid payment method is required at signup. You will not be charged during the 7-day trial.
• Billing. If you do not cancel before the trial ends, your payment method will be charged $10 on day 8, and $10/month thereafter until you cancel.
• Cancellation. You may cancel at any time from your account page or the Stripe billing portal. Cancelling before the trial ends means you will not be charged.
• Access period. A completed payment provides 30 days of access from the date of purchase. If a scheduled renewal payment fails, access may be revoked immediately.
• Refunds. Subscription payments are generally non-refundable, including partial billing periods, except as required by applicable law.

4. Disclaimer — No Guarantee of Profit

The Service is provided for entertainment and informational purposes only. Expected-value calculations and model probabilities are statistical estimates, not guarantees. Past performance is not indicative of future results. Sports betting involves substantial risk, and you may lose some or all of the money you wager, regardless of the information provided by the Service.

We make no representation or warranty that using the Service will result in profitable betting outcomes. You should never wager more than you can afford to lose. If you or someone you know has a gambling problem, call or text 1-800-GAMBLER for confidential support.

5. Prohibited Uses

You agree not to:

• Use the Service if you are under 18, or under the legal age for gambling-related activity in your jurisdiction, whichever is higher.
• Use the Service in a jurisdiction where sports betting or the receipt of sports betting data is prohibited by law.
• Access the Service using automated scripts, bots, or scrapers to extract data at scale, or to circumvent subscription access controls.
• Resell, redistribute, or publicly republish picks, odds data, or analysis obtained through the Service without our written permission.
• Attempt to interfere with, disrupt, or gain unauthorized access to the Service, its servers, or other users' accounts.
• Use the Service for any unlawful purpose, including money laundering or evading sportsbook account restrictions through misrepresentation.

6. Intellectual Property

All content on the Service — including the Posit+EV name and logo, the website design, underlying models, methodology, software, and compiled data presentations — is the property of PositEV or its licensors and is protected by copyright, trademark, and other intellectual property laws. Your subscription grants you a limited, non-exclusive, non-transferable license to access and view this content for your personal use. It does not grant you any ownership rights or license to reproduce, distribute, or create derivative works from it.

Third-party odds, team names, and league data referenced on the Service remain the property of their respective sportsbooks, leagues, and data providers.

7. Limitation of Liability

To the fullest extent permitted by law, PositEV and its owners, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages — including but not limited to lost profits, lost wagers, or lost data — arising out of or related to your use of the Service, even if we have been advised of the possibility of such damages.

The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of accuracy, merchantability, fitness for a particular purpose, or non-infringement. Odds and data may be delayed, incomplete, or inaccurate at any given moment; always verify current odds directly with the relevant sportsbook before placing a wager. Our total aggregate liability to you for any claim arising from these Terms or the Service is limited to the amount you paid us in the 3 months preceding the claim.

8. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, for conduct that we believe violates these Terms or is otherwise harmful to other users, us, or third parties. You may stop using the Service and cancel your subscription at any time as described in Section 3.

9. Governing Law

These Terms are governed by the laws of the United States and the state in which PositEV operates, without regard to conflict-of-law principles. Any dispute arising from these Terms or the Service will be resolved in the courts of competent jurisdiction in that state.

10. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the effective date at the top of this page. Continued use of the Service after any update constitutes your acceptance of the revised Terms.
